Terms & Conditions – Sale Quote | conveyonline

1.Payment Terms

A non-refundable initial payment as listed in this quote is payable on acceptance of this quote. The remaining balance will be payable on settlement of your matter. If your matter does not proceed to settlement or we cease to act for you prior to settlement, you will be required to pay our reasonable costs for any works completed on your matter.

 

2.Quote Acceptance

Acceptance of this quote must be done so via the ‘Let’s Get Started’ page on our website. conveyonline.com.au will not commence working on your matter until your quote has been formally accepted in this manner and your initial payment has been received by our office.

 

3.Quote Expiry

Your quote will be valid for 90 days from the date listed on this quote. Any prices quoted may change after this term without further notice to you.

 

4. Disbursements

Quoted disbursement charges are a best estimate only based on the property type and location entered by you in the quote form. Every property title is unique and can have additional dealings or easements registered on the title so the actual charges for those disbursements can vary in some cases. Conveyonline will always advise you if the disbursement charges will exceed the estimate provided and get your approval before proceeding any further. See below examples of disbursements that can be in addition to our quoted estimate:

Building Over Sewer Line diagram – See section  (13.1) for further information.

Additional Dealings registered on title – See section (13.2) for further information.

 

5.Property Types

Your quote is based on the type of the property as entered by you in the quote form. Any variation to this may alter the price quoted. See below definitions of property types for reference.

Existing House – Refers to an un-attached residential dwelling with a current occupation certificate. Excludes property within a strata plan or community title.

Existing Apartment/Unit – Refers to an attached residential dwelling with a current occupation certificate within a strata plan or community title.

Existing Commercial property – Refers to any existing property with a current occupation certificate that is used for business activities. May include retail shop, office space, factory, farms or vacant land.

 

6.Property Locations

Your quote is based on the location of the property as entered by you in the quote form. Any variation to this may alter the price quoted.

 

7.Areas of service

conveyonline.com.au is currently licensed to conduct conveyancing for properties located in NSW ONLY. This quote is not valid for any properties outside of NSW.

 

8.Settlement Venue

PEXA – conveyonline.com.au will by default settle your matter electronically using PEXA (Property Exchange Australia), which is a state government/bank owned online property exchange network.  Fees associated with performing your settlement on the PEXA network are excluded from this quote as they are charged to you directly by PEXA on settlement. The current price for a single title PEXA transactions is $110.55.

Manual Settlements – conveyonline.com.au will only conduct manual settlements if your matter cannot be settled using PEXA at the request of the purchaser or any financial institutions involved in the settlement. If your matter can be settled on PEXA and you subsequently elect a manual settlement, additional charges will apply as determined by conveyonline.com.au.

Settlement Agent – If a manual settlement does occur, settlement agents fees are excluded from this quote as they are charged to you directly by the settlement agent on settlement. The current settlement agents fee is $66.00 for a settlement that occurs in the Sydney region.  If settlement is to occur in any other region, additional fees may apply.

 

9.Failed Settlements

Your quote allows for one attempt of settlement. If for any reason an attempt at settlement fails, an additional charge may apply for any subsequent attempts at settlement. See additional charges table below for current prices.

 

10.Interest/Penalties/Taxes

conveyonline.com.au will not be liable for any interest, penalties or taxes from the purchasers or any other party as a result of late settlement or for any other reason.

 

11.Third Party Charges

conveyonline.com.au will not be liable for any charges you may incur from a third party as a result of late settlement or for any other reason. These charges may include but are not limited to; rent; accommodation charges; removalists costs and storage fees.

 

12.Third Party Offers

Any third party offers or discounts shown on your quote is not a referral, or recommendation of that third party.  conveyonline.com.au DOES NOT receive any form or financial incentive or benefit from any third parties to show their offers. conveyonline.com.au only displays offers for associated products and services which may be of benefit to our prospective clients.

 

13.Exclusions

 13.1.Building Over Sewer Line – If the property you propose to sell resides over a sewer line, a Building Over Sewer Diagram or Drainage Diagram may be required for the purpose of your sale contract. This is not included in our fixed fee and will be charged at cost. See additional charges table below for current prices.

 13.2.Additional Dealings on Title – Refers to any additional dealings that must be attached to your sale contract as listed on your title. This quote includes the provision for two dealings, however in some cases additional dealings are listed on title and must be attached to your sale contract. The number of dealings cannot be detirmined without completing a title search on your property. See additional charges table below for current prices.

13.3.Additional Documents – Any other documents that are required for your sale which are not included in our inclusions list will be charged in addition to our fixed fee.

 13.4.Banking of Settlement Funds – If online settlement venuw PEXA is not utilised, this quote assumes that any settlement funds owing to you will be paid to you via a Bank Cheque and then mailed to you using trackable mail. You may also elect to have funds direct credited to your bank account by your discharging mortgagee. If however you require a bank cheque to be deposited to your bank account manually over the counter, additional charges will apply. See additional charges table below for current prices.

13.5. Verification of Identity – Due to new legislation for transfers of property, you will be required to have a face to face identity verification check with one of our ID agents ZIP ID or Australia Post. Any fees payable to our agents are not included in this quote and should be paid directly to the agent. See additional charges table below for current prices.

 13.6. PEXA Fees – PEXA (Property Exchange Australia) is a state government/bank owned online property exchange network. Fees associated with performing your settlement on the PEXA network are excluded from this quote as they will be charged to you directly by PEXA on settlement. The current price for a single title PEXA transactions is $110.55.

 13.7.Other Additional Works – Any additional works requested by you, your mortgagee or any other parties to your transaction that falls outside the normal scope of a standard conveyancing matter will be charged at an additional rate as determined by conveyonline.com.au.
